Annex D — Fees and Commissions

Introduction

This Annex forms an integral part of the Secondgear Terms and Conditions of Use (the "Terms") pursuant to Section 4.3 thereof and sets out the financial details of Sections 9 and 11.

All amounts are expressed in euro and are not subject to VAT under Article 1, paragraph 58, of Italian Law No. 190 of 23 December 2014, because of the tax regime referred to in Section 1 of the Terms. The amounts shown are therefore the full amounts due.

PART I — SALES COMMISSION

D.1 — Calculation principles

D.1.1 — Calculation basis. The commission is calculated exclusively on the price of the Item multiplied by the quantity purchased: commission = unit price × quantity × category rate.

D.1.2 — Exclusions from the basis. The following are never included in the calculation basis:

  • shipping costs;

  • customs clearance fees;

  • import taxes;

  • any fees for Sponsorship Services.

D.1.3 — Determination of the rate. The rate is determined by the leaf category to which the Item is assigned, according to the list in Section D.2. For Bundles, the rate of the category to which the Bundle is assigned applies.

D.1.4 — Rates. There are three rates: 0%, 3% and 6%. No commission is due for categories with a 0% rate.

D.1.5 — When the commission accrues. The commission accrues when the payout to the Seller is made, once the period during which the funds are unavailable under Section 10.5 of the Terms has elapsed, and is withheld at that time from the amount paid out under Section 10.4. Until the payout is made, the commission is not due.

D.1.6 — Return and refund. In case of a full refund to the Buyer, the commission is not due and is returned to the Seller or not withheld.

D.1.7 — Rounding. Amounts are calculated in euro cents and rounded to the nearest cent according to standard commercial practice.

D.1.8 — Transparency. The applicable rate is shown to the Seller before the Listing is published and summarised in the details of each order, together with the amount withheld and the net amount due.

D.2 — Rates by category

The rate of a top-level category applies to all its subcategories, except for the exceptions expressly indicated, which apply to the subcategory indicated and to those within it.

Airsoft Gun — 6%

All subcategories: electric, gas, spring and HPA rifles; CO₂, green gas and electric pistols; LMG and SMG machine guns; launchers.

Apparel — 6%

All subcategories.

Tactical Gear — 6%

With the following exceptions at 3%:

  • Slings;

  • Protections;

  • Pouches.

Accessories — 3%

With the following exceptions:

  • Night Vision: 6%;

  • First Aid: 0%.

Consumables — 3%

With the following exceptions at 0%:

  • Batteries;

  • Gas (CO₂ and green gas);

  • Maintenance;

  • BBs.

Upgrade Parts — 0%

With the following exception:

  • Mosfet / ECU: 3%.

External Parts — 0%

All subcategories.

D.3 — Calculation example

Purchase of an Item in a category with a 6% rate, priced at €100.00, in the small Band, shipped to mainland Italy (€9.00):

  • price of the Item: €100.00;

  • shipping costs: €9.00;

  • total paid by the Buyer: €109.00;

  • Secondgear commission (6% of €100.00): − €6.00;

  • amount paid out to the Seller: €94.00;

  • retained by Secondgear (commission + shipping): €15.00, of which €9.00 goes to the carrier.

Note. Shipping costs are never included in the amount paid out to the Seller: Secondgear collects them and uses them to pay the carrier.

PART II — SHIPPING COSTS

D.4 — How the rate is determined

The shipping rate is determined by the combination of:

  1. the Shipping Band declared by the Seller — small, medium, large, maxi;

  2. the destination zone, determined by the country and, for island destinations and certain territories, by the province or postcode.

The rate is applied per Item. Orders including several Items from the same Seller are charged the rate for each of them.

Rates include all charges and are not subject to VAT for the reasons set out in the introduction.

Volumetric weight is not used: the Band is determined by the actual weight of the parcel, within the limits set out in Section D.5.

D.5 — Shipping Bands

  • Small: up to 2 kg;

  • Medium: up to 5 kg;

  • Large: up to 15 kg;

  • Maxi: up to 20 kg.

A parcel exceeding the limits of the declared Band entails charging the additional cost under Section 11.3 of the Terms.

D.6 — Rates by zone

Rates per Item, in the order small / medium / large / maxi.

Italy — mainland (all provinces except those listed in the next entry): €9.00 / €12.00 / €17.00 / €24.00.

Italy — Calabria, Sicily and Sardinia (for Calabria: the provinces of Cosenza, Catanzaro, Crotone, Reggio Calabria and Vibo Valentia; ferry crossing included): €12.00 / €16.00 / €22.00 / €32.00.

Europe — zone 1 (Germany, Austria, Poland, Czech Republic, Hungary, Slovenia, Croatia): €12.00 / €18.00 / €24.00 / €34.00.

Europe — zone 2 (mainland France, mainland Spain, mainland Portugal, Netherlands, Belgium, Luxembourg, Slovakia): €14.00 / €20.00 / €28.00 / €38.00.

Europe — zone 3 (Denmark, Ireland, Estonia, Latvia, Lithuania, Switzerland, United Kingdom): €18.00 / €24.00 / €36.00 / €50.00.

Europe — zone 4 (Greece, Romania, Bulgaria, Sweden, Finland, Norway): €22.00 / €30.00 / €42.00 / €56.00.

Balearic Islands (Spanish postcodes 07xxx): €28.00 / €34.00 / €42.00 / €52.00.

Corsica (French postcodes 20xxx): €44.00 / €50.00 / €58.00 / €68.00.

Madeira and the Azores (Portuguese postcodes 9xxx): €66.00 / €70.00 / €78.00 / €88.00.

Shipping to countries not listed is not available; the Canary Islands, Ceuta, Melilla and the French overseas departments and territories are not served either. The up-to-date rate card can in any case be consulted during the purchase, where the rate actually applied to the destination given is shown.

D.7 — Customs clearance fees

For shipments to Switzerland, the United Kingdom and Norway, a customs clearance fee of €7.00 per parcel is applied, shown during the purchase as an item separate from the shipping costs.

This fee covers only the customs clearance formalities. Import duties, import VAT and any other tax required by the authorities of the destination country are borne by the Buyer and are requested on delivery, as provided in Section 15.4 of the Terms.

D.8 — Cost of the return label

The cost of the return label equals the shipping rate applied to the Item in the original shipment, according to the rate card in Section D.6.

It is borne by the Buyer and is deducted from the refund amount under Section B.16 of Annex B. It is shown to the Buyer before the return request is confirmed.

PART III — COMMON PROVISIONS

D.9 — Tax document

Secondgear issues and makes available to the Seller the tax document relating to the commission and to any Sponsorship Services purchased, bearing the wording on the flat-rate regime required by the legislation in force.

The document is made available in the personal area in a downloadable format and is transmitted, where the conditions are met, through the Italian electronic invoicing exchange system (Sistema di Interscambio).

D.10 — Changes to fees

Changes to commission rates, shipping rates and the fees in this Annex are notified to Sellers with the notice period of no less than fifteen days referred to in Section 27 of the Terms.

Changes have no retroactive effect. In particular, they do not apply:

  • to orders already concluded;

  • to payouts already accrued;

  • to Listings published before the date on which the change takes effect, until they naturally expire or are removed.

A Seller who does not wish to accept the change may terminate without charge before it takes effect.
