Introduction

This Annex forms an integral part of the Secondgear Terms and Conditions of Use (the "Terms") pursuant to Section 4.3 thereof. Terms defined in the Terms have the same meaning here.

This Annex governs what may and may not be offered for sale on the Platform. The operational rules on the categorisation, naming, description and photographic representation of Items are set out in the Catalog Rules, published separately, which supplement this Annex without derogating from it. In case of conflict, this Annex prevails.

The list of prohibited Items is not exhaustive. Secondgear may remove Listings relating to Items which, although not expressly listed, are contrary to mandatory rules, public order or public morality, or are incompatible with the nature and purposes of the Platform.

The publication of a Listing in no case constitutes a certification that the Item complies with applicable law. Checking that the sale, possession, shipment and export are lawful is the sole responsibility of the Seller.

A.1 Airsoft Replicas: what is allowed

A.1.1 Definition and threshold

Compressed-air or compressed-gas weapons of limited offensive capacity may be offered for sale, namely those whose projectiles deliver a kinetic energy not exceeding 7.5 joules, pursuant to Article 2(3) of Italian Law No. 110 of 18 April 1975, as amended by Legislative Decree No. 204 of 26 October 2010.

Such devices are not common firearms, are not subject to the declaration of possession under Article 38 of the Consolidated Public Security Act (T.U.L.P.S.) and may be freely purchased by adults.

A.1.2 Prohibition of sale to minors

The sale of Replicas to persons under eighteen is prohibited by law. The prohibition rests on the Seller as the transferor. A Seller who knows, or has reasonable grounds to believe, that the Buyer is a minor must refrain from shipping and report the circumstance to Secondgear.

A.1.3 Requirements for the item offered

The Seller warrants that the Replica offered:

a) delivers a kinetic energy not exceeding 7.5 joules in the configuration in which it is sold;

b) bears the non-removable red tip at the end of the barrel, where required by the rules applicable to imitation weapons under Article 5 of Law 110/1975, or any other colouring or distinctive marking required by the law of the destination country;

c) bears the original identification markings applied by the manufacturer and, where required, the certification of the Italian National Proof House (Banco Nazionale di Prova);

d) has not been modified so as to raise its kinetic energy above the legal threshold.

A.1.4 Obligation to truthfully declare kinetic energy

The Seller must state in the Listing the kinetic energy of the item actually offered, not the nominal catalogue value, where the two differ as a result of modifications, wear or replacement of components.

Declaring an untrue value constitutes a serious breach of these Terms and entails the removal of the Listing, the suspension of the Account and, in the most serious cases, a report to the competent authorities. The Seller is solely liable for the consequences, including criminal ones, of transferring a device that exceeds the legal threshold.

A.1.5 Upgraded and modified Replicas

Replicas that have been modified, upgraded or tuned so as to deliver a kinetic energy exceeding 7.5 joules are prohibited, even if the Seller declares their power. Such devices are common firearms under Article 2 of Law 110/1975 and are subject to the authorisation regime provided for therein, which is incompatible with sales between private individuals on an online platform.

The offering of components advertised as capable of exceeding the legal threshold, or described with power ratings above 7.5 joules, is likewise prohibited.

A.1.6 Removal of the red tip

It is prohibited to offer Replicas without the red tip where it is required, or to advertise, describe or depict the Item with the tip removed.

A.2 — Weapons and weapon parts: absolute prohibition

It is absolutely prohibited to offer for sale:

A.2.1 — Firearms of any kind, whether common, military or military-type, including those that are deactivated, demilitarised, inoperable or collectible.

A.2.2 — Compressed-air or gas weapons with a kinetic energy exceeding 7.5 joules, which are common firearms.

A.2.3 — Firearm parts: barrel, frame, receiver, stock, bolt, cylinder and any other component subject to the same regime as the weapon to which it belongs.

A.2.4 — Ammunition, cartridges, primed cases, bullets, primers, gunpowder and any other explosive or propellant material.

A.2.5 — Magazines for real firearms, of any capacity.

A.2.6 — Silencers and sound moderators intended for real firearms. Only mock suppressors intended for Replicas, with no ballistic effect, are allowed.

A.2.7 — Clandestine weapons, without identification markings or with an erased, altered or counterfeit serial number, pursuant to Article 23 of Law 110/1975.

A.2.8 — Hunting crossbows, hunting bows and their hunting points, as well as any instrument capable of causing harm similar to those referred to in Article 4 of Law 110/1975.

A.2.9 — Improper weapons and offensive instruments: brass knuckles, knuckle-dusters, sword canes, spiked maces, batons, chains with handles, electric stun devices and similar devices.

A.2.10 — Switchblade and automatic-opening folding knives, daggers, stilettos and bladed weapons without a recognisable sporting, professional or utility purpose.

A.2.11 — Irritant sprays and chemical self-defence devices, of any composition and capacity.

A.2.12 — Pyrotechnic articles: pyrotechnic smoke devices, firecrackers, grenades with an explosive or incendiary charge, rockets, flares and any product falling within the scope of Italian Legislative Decree No. 123 of 29 July 2015. Only Airsoft grenades and mines operating pneumatically or by gas, with no pyrotechnic charge, are allowed.

A.2.13 — Explosives precursors subject to restriction under Regulation (EU) 2019/1148.

A.3 — Items allowed with warnings

A.3.1 Optics, sights and aiming devices

Optical sights, holographic sights, red dots, magnifiers and similar accessories are allowed.

Laser pointers of a class higher than class 2, and in any case with a power above 1 mW, as well as devices without the required safety markings, are prohibited.

A.3.2 Night vision and thermal imaging devices

Night vision devices, image intensifiers and thermal imaging equipment are allowed.

Warning — dual-use items. Such devices may fall within the dual-use items listed in Annex I to Regulation (EU) 2021/821, and their export outside the European Union may require a specific authorisation. It is the sole responsibility of the Seller to check the classification of the item offered and to refrain from shipping to non-EU destinations without the required authorisations.

A.3.3 Ballistic protection and technical clothing

Tactical vests, plate carriers, anti-trauma protection, masks, protective eyewear and helmets are allowed.

Ballistic panels and plates with actual bullet-resistant capacity are prohibited, because of export restrictions and the restrictions in force in several destination countries. Only mock inserts with no ballistic capacity are allowed, provided they are expressly described as such.

A.3.4 Uniforms, camouflage and insignia

Camouflage clothing, generic uniforms, surplus equipment and fantasy patches are allowed.

The following are prohibited: complete uniforms and authentic insignia in use by the Armed Forces, Police Forces and State Corps of Italy or other countries, capable of creating confusion about membership of such bodies; identity cards, rank insignia and identification tags; any Item whose use would constitute the offence under Article 498 of the Italian Criminal Code.

A.3.5 Batteries and propellant gases

Lithium-ion and lithium-polymer batteries are allowed only if built into the Item and in intact condition, in compliance with the carrier's requirements for the transport of dangerous goods. Swollen, damaged or unmarked batteries are prohibited.

The sale and shipment of compressed gas cylinders and cartridges, including green gas, propane, CO₂ and compressed air, are prohibited, as they are goods subject to the rules on the transport of dangerous goods.

A.4 — Items prohibited in any case

Regardless of whether they relate to Airsoft, it is prohibited to offer for sale:

A.4.1 — Counterfeit Items, bearing non-authentic trademarks or unauthorised reproductions of protected designs.

A.4.2 — Items of unlawful origin, stolen, received as stolen goods or otherwise not lawfully at the Seller's disposal.

A.4.3 — Narcotic and psychotropic substances and related paraphernalia.

A.4.4 — Medicines, medical devices, supplements and doping substances.

A.4.5 — Tobacco, inhalation products and alcoholic beverages.

A.4.6 — Live animals, animal parts and products of species protected under the CITES Convention.

A.4.7 — Identity documents, qualifications, licences, certifications and any document capable of being used in place of authentic ones.

A.4.8 — Personal data, contact lists, credentials and accounts.

A.4.9 — Legal tender, financial instruments, vouchers and negotiable instruments.

A.4.10 — Material inciting hatred or violence, discriminatory material, and objects and symbols associated with organisations dissolved or prohibited under Italian Law No. 645 of 20 June 1952 and Law No. 205 of 25 June 1993. The possession and sale of historical memorabilia with no propaganda purpose are allowed where they do not constitute the offences provided for therein.

A.4.11 — Pornographic or sexually explicit material.

A.4.12 — Hazardous chemicals, radioactive materials and products subject to restriction under Regulation (EC) No 1907/2006.

A.4.13 — Devices intended for intercepting communications, blocking signals (jammers), cloning access devices or circumventing security measures.

A.4.14 — Services, professional services, work services and intangible goods with no physical medium, since the Platform is dedicated to the sale and purchase of tangible movable goods.

A.4.15 — Items subject to a market recall or reported as dangerous through the European Union's Safety Gate portal.

A.5 — Prohibited conduct when publishing

In addition to what is provided for in the Terms, the following conduct is prohibited:

A.5.1 — Misleading Listings. Untrue descriptions, omission of relevant defects, photographs not relating to the item offered, indication of a condition that does not correspond to reality.

A.5.2 — Improper categorisation. Assigning the Item to an irrelevant category in order to increase visibility or to circumvent kinetic energy checks.

A.5.3 — Non-genuine prices. Stating a price that does not correspond to the price actually asked, token prices intended to move the negotiation off the Platform, prices manifestly out of line with the value of the Item.

A.5.4 — Bait Listings. Publishing Items that are not available or not genuinely intended for sale.

A.5.5 — Duplication. Repeatedly publishing the same Item in several Listings in order to occupy multiple positions in search results.

A.5.6 — Inclusion of contact details. Stating, in the text of the Listing, the title, the images or the profile, telephone numbers, email addresses, references to external messaging services, social media profiles or bank details, in breach of Section 17.2 of the Terms.

A.5.7 — Referral to external channels. Express or implied invitations to conclude the transaction outside the Platform.

A.5.8 — Third-party content. Using texts, photographs or videos taken from other Listings, from third-party catalogues or from copyright-protected sources, without entitlement.

A.5.9 — Manipulation of search results. Including in the title or description trademarks, models or keywords not relevant to the Item offered.

A.5.10 — Circumvention of measures. Republishing removed Listings, unless the causes of the removal have been eliminated, and using secondary Accounts to get around a suspension.

A.6 — Consequences of breaches

Breaches of this Annex entail the adoption of the measures referred to in Section 20.3 of the Terms, graduated according to proportionality criteria based on the seriousness of the breach, its repetition and the intent involved.

The following, as a rule, entail the immediate closure of the Account, in addition to a report to the competent authorities where the conditions are met:

  • offering the Items referred to in Section A.2;

  • an untrue declaration of kinetic energy under Section A.1.4;

  • offering Items of unlawful origin;

  • producing false documentation to obtain the authorisation referred to in Section 14.3 of the Terms;

  • repeated breach of the prohibition on sales to minors.

Every measure is notified with the statement of reasons referred to in Section 20.4 of the Terms and is subject to the review referred to in Section 20.5.

A.7 — Notices

Anyone may report a Listing they consider contrary to this Annex using the dedicated function on each Listing or by writing to [email protected], following the procedure referred to in Section 20.2 of the Terms.
